Corporate financing with brands and patents

It frequently is that case that, in times of the world-wide economic crisis, intangible assets represent a substantial value for the corporation who owns these. If real estate and machines (no longer) are available as classic securities, intangible assets such as, e.g. brands and patents, can serve as valuable financing instruments within the framework of credit risk mitigation, rating-optimisation (Basel II) or sale-and-lease-back-proceedings. Brands – valuable assets, even in times of crisis, as the case of porcelain manufacturer Rosenthal shows

In times of global economic crisis intangible assets often represent a significant value for the company that owns them. The insolvency of Rosenthal AG shows that trademark rights and their valuation are also of great significance in insolvency. But it is not only in insolvency, but also in the scope of collateralisation, rating optimisation (Basel II) and sale-and-lease-back processes that intangible assets such as brands serve as valuable instruments of financing. IP-Valuation values the Rosenthal and Thomas brands of Rosenthal AG on behalf of Schultze & Braun, one of the largest law offices specialising in insolvency law. Well-established and well-known brands often represent a significant value in the insolvency of an ailing company. "This is undoubtedly the case with the recently-concluded insolvency proceedings of Rosenthal AG, in which the company brand Rosenthal and product brand Thomas have proven to be valuable assets in the scope of the search for a buyer," says Rosenthal administrator Volker Böhm of Schultze & Braun. IP-Valuation GmbH was assigned with evaluating the Rosenthal and Thomas brands by Mr Böhm. In the course of a detailed, transparent and prompt valuation of these trademark rights, IP-Valuation was able to make a valuable contribution to the search for a buyer in the scope of the Rosenthal insolvency case.

IP-Valuation Research: The significance of trademarks in accounting practices of HDAX companies

Analysis of the HDAX management reports for the business year 2005 or 2005/2006, being the first year for mandatory consolidated financial statements in accordance with IAS/IFRS, shows that intangible assets in the balance sheet play a significant role, whereas the proportion of trademark equity recorded in the balance sheet is still relatively low. But in the future the recorded figure for trademark equity will continue to increase on account of the number of corporate transactions and the increasing number of IAS/IFRS consolidated financial statements and individual accounts – a reason why more and more German companies and auditing firms will have to come to grips with the issue of accounted trademark equity.

IP-Valuation showcased at EU trademark valuation conference

Held in Copenhagen on 7 June 2007, „The Value of Trademarks“ was staged by the EU’s Office of Harmonization for the Internal Market and by the Danish Patent and Trademark Office. One of the topics examined at this ‘trademark valuation summit’ was the world’s first trademark valuation software. Speaker was Robert Tafelmeier, CEO of the Munich-based IP-Valuation GmbH, which recently launched the first-on-the-market BrandValue software.

The German technical service corporation - TÜV SÜD - confirms the quality of the trademark valuation software BrandValue

The certificate confirms the high degree of reliability and accuracy of the world's first ever software-based trademark valuation process


Excellent! BrandValue, the world's first trademark valuation software, developed by the company IP-Valuation (Munich, Germany), has been presented the TÜV SÜD certificate, confirming the high-quality standard of the software. Since May the TÜV SÜD Product Service GmbH had given BrandValue a thorough check-up. In addition, audits of the system processes were conducted and the relevant documents, such as specification, development, test, quality assurance, product description, further development etc. were assessed. The result: the trademark valuation software Brand-Value has successfully passed the test and been awarded the TÜV SÜD Product Service GmbH certification. The basis for the assessment were the TÜV SÜD certification guidelines based on the ISO standard ISO / IEC 12119: "Information technology, software products – quality requirements and testing procedure"

BrandValue finds solutions to the problematic aspects of monetary trademark valuation

Expert's report confirms the high level of plausibility, objectivity and transparency for a valid trademark valuation process


Since 2005 companies quoted on the stock exchange are obliged to determine the monetary value of trademarks according to the principles of the International Financial Reporting Standards (IAS/IFRS), and to record the figures in their balance sheet. In view of the bewildering number of methods that could be applied, this is no easy undertaking, particularly as most of them are based on vague factors that lack transparency.
